It’s a good idea to take a plea deal only when there are no better options. My goal is always going to be to get your case dismissed. If a dismissal isn’t possible, we discuss the pros and cons of taking your case to trial. Whether to go to trial is always the client’s decision.

Trials always carry risk, and whether it’s a good idea to go to trial depends on the evidence, your criminal history, the punishment range you’re facing, and possible job or reputation consequences if the worst happens and we lose. I know of no experienced defense attorneys with a perfect win record. If a lawyer tells you they’ve never lost a trial in their career, they’re either lying to you or have carefully avoided taking tough cases to trial.

If you’re not willing to accept the risk of conviction at trial and the plea offer is far better than the punishment you’d likely receive if we lost (or, better yet, the offer allow you to keep your record clean), then it’s something to consider. But only if there is no other possible way to get a better result in your case.
