If you’ve been found guilty after a trial, your case isn’t necessarily over. You can appeal. A good appellate attorney is often the only difference between getting your conviction overturned and having a criminal record for the rest of your life. I can handle your appeal and ensure that you have the best chance of getting your conviction thrown out.
But don’t delay. The deadlines to file a notice of appeal are short, 90 days if your trial lawyer filed a motion for a new trial or just 30 days if he didn’t. If you’re thinking of appealing your case, it’s important that you call now. Because once those deadlines are gone, so is your right to appeal your case.
If your conviction was upheld on appeal, you never appealed your case, or even if you pled guilty, I may still be able to get your conviction overturned through something called a writ of habeas corpus. I’m one of only a few attorneys in the Houston area who practices in this complex area of law, and I’ve gotten years-old convictions overturned for clients who pled guilty in their cases.
There are many grounds for filing a writ of habeas corpus, but the most common is if you received ineffective assistance from your lawyer. If your lawyer didn’t investigate your case, gave you wrong legal advice, or misinformed you about the consequences of pleading guilty, you may be able to have your conviction overturned through a writ of habeas corpus. I can also file a writ of habeas corpus in your case if new evidence has come to light that can prove your innocence.
