If you received a sentence of probation, filing your appeal will stop your probation from starting unless and until your case is affirmed on appeal.
If you received a jail sentence, it depends on the length of the sentence and the type of case.
For serious violent felony cases, such as murder, kidnapping, sexual assault, burglary, aggravated robbery, and cases involving deadly weapons, you have to serve your sentence while the appeal is pending.
For misdemeanor cases and non-violent felony cases where you were sentenced to less than 10 years in prison, the judge has the option of giving you an appeal bond.
An appeal bond is like a regular bond. You’ll put up money to make the bond and will be free while your case is pending on appeal.
